These Terms & Conditions govern the use of the website naviaassist.com and the services provided by Navia EOOD / Navia LTD, UIC/EIK 208760135 (“Navia”, “we”, “us”, or “our”).
By accessing or using our website, services, or the Navia AI Assistant, you agree to these Terms.
If you do not agree, you must not use the service.
1. About the Service
Navia provides digital services including but not limited to: AI-powered assistant (“Navia AI Assistant”), Website development, Web platforms, AI automations, E-commerce systems, Technical consulting, Support & maintenance services.
Navia AI Assistant is an artificial intelligence system designed to: interact with website visitors, answer questions, collect inquiries, qualify leads, assist businesses with communication. The assistant is not a human and operates based on automated logic and AI models.
2. Acceptance of Terms
By using: naviaassist.com, the Navia AI Assistant, any Navia service, you confirm that: you are legally capable of entering into an agreement, you agree to these Terms, you will use the service in compliance with applicable laws.
3. Use of the Service
You agree NOT to: use the service for illegal purposes, submit false or misleading information, attempt to exploit or manipulate the AI system, overload or abuse the system (spam, automation attacks), attempt unauthorized access to admin systems, use the service to collect or process sensitive data unlawfully.
Navia reserves the right to: limit access, suspend usage, block requests, terminate service, without prior notice if misuse is detected.
4. AI Disclaimer
Navia AI Assistant is powered by artificial intelligence. You acknowledge that: responses are automatically generated, responses may be inaccurate, incomplete, or outdated, the system does not guarantee correctness, the system may misinterpret user input. Navia does NOT provide: legal advice, medical advice, financial advice, technical certification, safety-critical recommendations.
You must NOT rely on the assistant for important decisions without independent verification.

5. Limitation of Liability
To the maximum extent permitted by law:
Navia shall NOT be liable for: decisions made based on AI responses, loss of business, revenue, or opportunities, incorrect or incomplete information, system downtime or interruptions, data loss outside reasonable control, third-party service failures (e.g. APIs).
The service is provided “as is” and “as available” without guarantees.
6. Client Responsibilities
Clients using Navia AI Assistant on their websites are responsible for: informing their users that an AI assistant is used, including proper Privacy Policy and disclosures, ensuring lawful data collection, reviewing leads before contacting them, verifying all collected information, handling user data in compliance with GDPR. Navia acts as a data processor where applicable. The client remains the data controller for their website users. Clients are also responsible for reviewing and understanding the applicable subscription terms, billing conditions, refund rules, and recurring payment structure before purchasing the service.
7. Data Collection & Privacy
Use of the service is also governed by our Privacy Policy. Navia may collect: messages, contact details, technical data, interaction logs, for purposes including: service functionality, lead generation, system improvement, security.
By using the service, you acknowledge such processing.
8. Third-Party Services
Navia may rely on third-party providers, including: AI APIs (e.g. OpenAI), hosting providers, email services. Navia is not responsible for: failures of third-party services, external outages, data handling outside our direct control.
9. Availability of Service
We aim to provide a stable service but do NOT guarantee: uninterrupted availability, error-free operation, continuous uptime. We reserve the right to: modify features, update systems, temporarily suspend access, without liability. Certain features or access to the service may depend on an active subscription or successful recurring billing status.
10. Intellectual Property
All content, code, systems, and technology related to Navia are owned by Navia. You may NOT: copy the system, reverse engineer, resell without permission, reproduce or distribute without authorization.
Clients receive a limited right to use the service, not ownership.
11. Payments & Billing (if applicable)
Certain Navia services may be offered as paid, subscription-based, recurring, yearly, monthly, custom, or one-time services.
By purchasing a subscription or paid service through naviaassist.com, the client authorizes recurring automatic payments through the selected payment provider according to the selected billing cycle until the subscription is canceled.
Subscription renewals may occur automatically unless the client cancels the subscription before the next renewal date. Clients are responsible for maintaining valid payment information, monitoring their active subscriptions, reviewing billing dates, and canceling subscriptions before renewal if they do not wish to continue using the service.
Monthly subscription payments are generally non-refundable once the billing cycle has started.
Yearly subscription plans may be eligible for a refund request within seven (7) calendar days from the initial payment date, subject to the applicable Return & Refund Policy published on naviaassist.com.
If a refund is approved, Navia reserves the right to suspend, deactivate, or terminate access to the related services, AI assistant, integrations, configurations, and associated systems.
Navia may suspend, limit, or terminate services in cases involving non-payment, failed recurring payments, payment disputes, chargebacks, suspected fraudulent activity, abusive behavior, or violation of these Terms & Conditions.
Payments may be processed through third-party payment providers such as Stripe. Navia does not store full payment card information on its own servers.

12. Termination
Navia may terminate or restrict access: for violation of Terms, for misuse, for non-payment, for security reasons. Clients may stop using the service at any time. Termination or cancellation of a subscription may result in suspension or removal of access to the Navia AI Assistant, admin panel, integrations, stored configurations, and related services.
13. Security
We apply reasonable security measures, but: no system is 100% secure, users are responsible for protecting credentials, clients must secure their admin access.
14. No Warranty
Navia provides services: without warranties of any kind. We do not guarantee: business results, conversion rates, accuracy of AI responses, suitability for a specific purpose.
15. Governing Law
These Terms are governed by the laws of: Republic of Bulgaria. Any disputes shall be resolved by the competent Bulgarian courts.
16. Changes to Terms
We may update these Terms at any time. Updated versions will be published on the website. Continued use of the service constitutes acceptance of the updated Terms.
